  • Regularization of real estate (land, existing construction, designated uses, etc.) and monitoring of situations with public authorities (e.g., real estate registries) at the municipal and national levels (INCRA, SPU, etc.
  • Advice in structuring real estate transactions, involving the drafting of necessary legal instruments for optimal business development (sale and purchase agreements, donation instruments, lease agreements, among others).
  • Preparation, monitoring, and registration of adverse possession claims, probate proceedings and extrajudicial divorces processed before notaries and real estate registries.
  • Support in defining structures in corporate (special purpose entities, shareholders’ agreements, real estate investment funds, consortiums, etc.) and real estate modalities to determine the ideal legal structure for a given enterprise.
  • Preparation and registration of real estate development projects and/or condominium declarations.
  • Boundary adjustments, unification, and/or subdivision of real properties.
  • Registration of subdivisions, including drafting descriptive memorandums, homeowners’ association formation, standard sale and purchase contracts, etc.
  • Drafting of contracts of all types, such as sale and purchase contracts of individual units; lease agreements (residential, commercial, etc.) and their registration (right of first refusal and/or term), construction contracts (labor contracts for work), build-to-suit agreements, among others.
